18 USC Section 1343 “Fraud by wire, radio or television” outlines the definition of and penalties for wire fraud under federal law. Wire fraud is defined as transmitting or having another transmit signals, writings, sounds or pictures through interstate wires, television or radio for the purpose of carrying out a scheme to defraud others of property or money. Whether or not the actual scheme is successful, transmitting data through interstate wires for the purpose of committing fraud is enough for a conviction under this federal statute.

Penalties may include fines and up to 20 years in state prison. If the offense affects a financial institution, the defendant may face up to 30 years imprisonment or a fine of up to $1,000,000, or both.
